1. Acceptance of Terms

By accessing or using Comments Platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Comments Platform provides an embeddable comment system for websites, including moderation tools, analytics, spam protection, and related features. The Service is currently in beta and may change without notice.

3. Account Registration

To use the Service, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Be at least 18 years old or have parental consent
  • Notify us immediately of any unauthorized access

You are responsible for all activities under your account.

4. Subscription and Payment

Free Plan: Available at no cost with usage limitations.

Paid Plans: Billed monthly or annually in advance. Founding member pricing is locked in for active subscribers. Cancellation takes effect at the end of the current billing period. No refunds for partial periods.

Price Changes: We reserve the right to change pricing for new customers. Existing subscribers maintain their current rate unless they cancel and resubscribe.

5. User Content

You retain ownership of all content posted through the Service. By using the Service, you grant us a license to store, display, and transmit your content as necessary to provide the Service.

You are responsible for:

  • All content posted by users on your sites
  • Moderating content to comply with applicable laws
  • Ensuring you have rights to use the Service on your websites

6. Prohibited Conduct

You may not:

  • Violate any laws or regulations
  • Infringe intellectual property rights
  • Post spam, malware, or malicious content
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Use the Service for illegal or harmful purposes

7. Service Availability

We strive for high availability but do not guarantee uninterrupted service. The Service is provided "as is" during beta. We may modify, suspend, or discontinue features at any time.

8. Data and Privacy

Your use of the Service is subject to our Privacy Policy. We collect and process data as described in that policy. You are responsible for complying with privacy laws applicable to your use of the Service.

9. Intellectual Property

The Service, including all software, designs, and trademarks, is owned by Comments Platform. You may not copy, modify, or reverse engineer any part of the Service.

10. Termination

We may suspend or terminate your account for violations of these Terms, non-payment, or at our discretion. You may cancel your account at any time from your dashboard.

Upon termination:

  • Your access to the Service will cease
  • Your data may be deleted after 30 days
  • No refunds will be provided for prepaid periods

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE PAST 12 MONTHS.

13. Indemnification

You agree to indemnify and hold harmless Comments Platform from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

14. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance. Material changes will be communicated via email or dashboard notification.

15. Governing Law
